After the issuance of Justice Richard Goldstone’s UN Report on the War on Gaza, I see compelling reasons for both Hamas and Israel to come before the International Court of Justice to face charges of war crimes. A Jewish war that caused the death of 1,387 mostly civilians including some 300 children and of course the total destructions of tens of thousands of homes, destructions of hospitals, schools among many other deliberate damage to infrastructure.

Of course the US government coward as it is in facing to the pressure and black mail of the powerful American Jewish community and leadership was quick to denounce the UN report as “ one sided” expressing “concerns” about the report’s recommendations. Of course we all need to remind our self and our readers that Justice Richard Goldstone is not an Arab, not an American but a South African Zionist Jews who did distinguish himself for many years in South Africa and The Hague. As such I do not understand the fear expressed by the State Department spokesman. I was surprised that the State Department did not denounce Justice Richard Goldstone as an Anti-Semitic and self hating Jew.

The 575 Goldstone report was too mild in its criticism of Israel concluding Israel used “ disproportionate” fire power and failed to avoid civilian death as if this is the first time that Israel used “disproportionate” fire power” in its wars against the Palestinians and the Arabs whether on its attacks on Gaza, Jennin, Qana, or Beirut. As for avoiding civilian targets Israel always make sure it targets civilians and targets innocent young civilians children in class rooms and on the way to school with soldiers bumping some dozen bullets in the body of a young school girl to “confirm” a killing.

The report also criticize Israel for deliberate destructions of nonmilitary targets such as schools, flour mills, chicken farms and water pumps concluding the Israel imposed siege of Gaza “might justify” the findings of “crimes against humanity”.

Of course and as expected and rightly so, Justice Richard Goldstone also addressed the issue of thousands of rockets fired by Gaza militants into southern Israel especially the Israeli town of Sderot where an alleged two dozen Israelis were killed and causing psychological trauma that “ would constitute war crimes and may amount to crimes against humanity” as if the daily targeted killings and daily raids by the Israeli army and armed settlers against Palestinians and destructions of their homes by Israeli bulldozers and the humiliating process of passing through some 650 Israeli checkpoints do not cause “psychological trauma” for Palestinians since they are used to this, unlike the Israelis who are too mentally delicate to face such daily trauma.

The report details so many instances of deliberate targeting of civilians and rounding them up and holding them hostage denying them medical access. One only can remember the targeting of journalists and medical workers by Israeli soldiers and the targeting of the family of a Gaza physician working in Israel killing his two daughters as he was giving a TV interview to Israeli television. Of course the brave Israeli tank commander simply firing a tank shell into the window of the house shortly after the physician complained to the Israeli reporter that Israeli soldiers are menacing his house. The rest is history. Of course and as expected the Israeli government totally rejected the Goldstone Commission with some Israeli officials calling Justice Goldstone an Anti-Semitic and even self hating Jews. I guess nothing ever pleases these Zionist Jews even if the entire world kneels before their feet and kiss their behind.

I have always stood against and always declared my total rejections of any acts that target civilians and totally rejected acts of suicide bombings carried out by Palestinians and totally rejected the targeting of civilians in restaurants, on buses and in coffee shops and in streets within Israel. However I always stood for the rights of Palestinians to use military means and fire power targeting Israeli Occupation forces and targeting armed Jewish settlers within the areas of 67 borders. The right to use armed means to resist foreign occupation is an absolute right that no nation or institutions could ever deny the Palestinians absolute right to resist by all means. Do I think armed resistance in this case makes sense? No I do not and I can see other and more powerful options to resist and defeat the Jewish Occupation?

Yes, why not for Hamas and its leadership to stand in the dock at the International Criminal Court and face the charges side by side to Israeli political and military leaders. Perhaps it is time for all sides to understand that civilians are off limits and that wanton destructions of homes and farms carry criminal and civil charges. Perhaps it is time for Israel at least this time around to face charges for crimes it has been committing for the last 85 years. And yes, it is time for Hamas leadership to understand that suicide bombing is non-starter and that its Qassam rockets are as useless as anything else and that in the end someone has to answer for the death of innocent people, on both sides of the Israeli-Palestinian conflict.

Do I think the prosecutor of the International Court of Justice will be able to pursue his case and bring Israeli leaders to the dock, absolutely not. Thanks to the US legal and political cover it gives to Israel. Israel got away with mass murder and will continue to receive “cover” for its crimes from the US and will never face charges for its crimes in Sabra and Shatilla, in Qana, in Hebron, in Beirut, in Jennin and now in Gaza. Thank you President Obama for following with your commitments to the “security of Israel” right or wrong. Do I think the Palestinian leadership in Ramallah will dare and file charges with the International Criminal Court? It will never dare to do that, risking losing the very rewarding and lucrative contract it has to mange the Jewish Occupation for and on behalf of Israel.
